Article-239A
Article 239A of the Indian Constitution pertains to the establishment of local legislatures, Council of Ministers, or both for specific Union territories.
The article is specific to Puducherry
The article also provides that, any law made by parliament for such a purpose alone will not be considered as an amendment of the constitution.
Therefore, such a bill needs to be passed by a simple majority alone.
Note1: Constitutional amendment bills need to be passed by a special majority, ie, majority of ⅔ of those present and voting and which is more than half the total membership of the house in parliament.
Note2: In the case of the Union Territory of Delhi, the Article 239AA provides for a legislature and council of ministers. The difference is that for Delhi the Article 239AA mandates a legislature and council of ministers, while for Puducherry, the power is given to the parliament under Article 239A.
