Article-239A

  • Article 239A of the Indian Constitution pertains to the establishment of local legislatures, Council of Ministers, or both for specific Union territories.

  • The article is specific to Puducherry

  • The article also provides that, any law made by parliament for such a purpose alone will not be considered as an amendment of the constitution.

  • Therefore, such a bill needs to be passed by a simple majority alone.

  • Note1: Constitutional amendment bills need to be passed by a special majority, ie, majority of ⅔ of those present and voting and which is more than half the total membership of the house in parliament.

  • Note2: In the case of the Union Territory of Delhi, the Article 239AA provides for a legislature and council of ministers. The difference is that for Delhi the Article 239AA mandates a legislature and council of ministers, while for Puducherry, the power is given to the parliament under Article 239A.
